Don don't park your race car 5 ft in the return road for three days. Then no one will hit it. I have had 15 plus people that have called over the passed 4 months saying they almost hit your dragster that weekend . I had over $3000 in damage to my car because you felt the need to park your dragster in the return road in ever racers way the whole weekend.
Don I had full control of my mustang, someone just choose not to park in there designated pit spot(you). Maybe some day you will understand why NHRA gives us a place to park our race cars(beside our trailer). Not on the back of the trailer advertising your product. Don't worry Iam in it for the long haul don

Charley, you might want to be careful what you say on here. I don't know either of you, but now that you have an attorney and are going to court, comments on here can be entered...
Take a step back, what you said is: "Don don't park your race car 5 ft in the return road for three days. Then no one will hit it. But none of the 15 plus people that called you hit Don's Dragster.....additionally, you wrote that it was parked like that for 3 days.....(your words, not mine) how many others drove by without hitting it,.....700-800???? So, you were the only one that actually hit it out of hundreds. Additionally, your comment about having full control of your Mustang.....same comment as above. Take a deep breath and talk with your attorney now that you have one. Don, my advise to you is to also hire an attorney. Otherwise you are like a one armed man in a fist fight. I believe your attorney will seek punitive damages, and recover your time away from work and attorney fees...... And, IMO you have shown "good faith".....others might disagree... Take this for what it is worth, and it didn't cost a dime.....Best of luck to both of you.

Parked car was at fault....... Judge Judy.....What's the verdict..... She finds the defendant guilty.....pay for the damages and courts costs.... Next case...

OK, I've stayed out of this until now. I have to say I know both of the racers involved in this. I see the points given by both sides, however, I think the situation would be best served for the two of them to hammer this out between each other. This might be great entertainment to a lot of people but this is a serious situation and there is nothing funny about it! I would advise both of them to stop the back and forth on this forum. Nothing good will come of it. It hasn't gotten out of control but it is going down hill fast. I don't want to see either of you say something you both will regret later. Jim

Considering that nobody should ever leave their race car half out on the return road, assume half the responsibility and be glad that the racer wants to help you Mr Higgins. Please also lighten up on the pen when considering damages. I'm always amazed when people want to blame others for not being responsible for their actions, leave your race car in the way of 800 plus car driving by, there is a good chance that percentage will catch up with you. Mr Downing and his family are a class act, try to learn from this event. Claude Ruel

I agree with Jim Wahl, don't know either Charlie or Don,but I'd say that you both will be better off if could come to agreement without going to court,I know sometimes this is'nt possible,but both parties are going to better off if can be done without going to court.
If you guys could work this out between the two of you it would be over,done you both could move on,go to court decision is going to be made, one could be really happy and one not very happy or with both unhappy. I don't know if you guys can,but would like for this get worked out and end on good terms I wish you guys the best of luck at resolving this,I really mean it not being sarcastic. Mike Taylor 3601 |
