Sorry to hear the bad news....I think Mr. Haddad was on the right trail. If you signed a work order OR if there was a repair order written then your chances of a solid case are better. A signed work order indicates a contractual agreement between you and the shop and legitimizes your car being left at that location. I do know that in many states ( applies here in NC ) there is a "Carriage Law " that states if a customer entrusts their vehicle to a repair shop, then the repair shop has the responsibility for the care and safety of your property. Maybe Texas ( or where ever the car was located ) has a similar law. Did this shop have a Garage Liability policy? Your reasoning to proceed to the next step is that the shop owner is not working with you in "Good Faith". I agree with others who posted, that you need an attorney, as many times they can reach settlement ( favorable to you ) without a court proceeding. I wish you luck in getting a good resolution.
