Filing a VA Claim
Title 38 Code of Federal Regulations (38CFR) specifies every criteria for disability claims. THREE things are required for a fully developed claim and a likely award.
1 DIAGNOSIS of a medical condition listed in 38 CFR by a Doctor. 2 DISABILITY determination of how the condition affects daily life or employability - your input via interview during C&P physical or even a buddy letter or lay statement. 3 NEXUS is a medical opinion that the disabling condition is *at least as likely as not* service connected. Some NEXUS are automatic. we call those PRESUMPTIVE. If your ears ring, VA will presume it is service connected because 80% of veterans have hearing impairment. Agent Orange has several presumptive diagnoses. PACT ACT has burn pit presumption - and more. Get those 3 things and you're on your way. |
